Coupon Redemption Policy

This Coupon Redemption Policy (“Policy”) outlines the terms and conditions for the redemption of coupons issued by Champion Foods LLC (“Company”). By accepting and redeeming our coupons, retailers (“Retailers”) agree to comply with this Policy. Submission of coupons for redemption signifies acceptance of these terms.

 

1. General Terms

  • Coupon Validity: Coupons are valid only in the fifty United States, the District of Columbia, U.S. territories and possessions, and U.S. military installations worldwide, including A.P.O. and F.P.O. addresses, unless otherwise restricted on the coupon.

  • Void Where Prohibited: Coupons are void where prohibited, taxed, or otherwise restricted.

  • Cash Value: Each coupon has a cash redemption value of .001¢

  • Non-Assignability: Coupons are non-assignable and void if transferred, sold, auctioned, reproduced, or altered in any way. Unauthorized distribution, collection, or sale of coupons is prohibited.

  • Consumer Use Only: Coupons are intended for individual consumer use and are not valid for products intended for resale.

 

2. Redemption at Retail

  • Purchase Requirements: Coupons are redeemable only when a consumer purchases the specific brand, size, quantity, and product(s) stated on the coupon. The face value of the coupon should be deducted from the Retailer’s current selling price.

  • One Coupon Per Item: Only one coupon may be redeemed per purchase of the specified product, and a maximum of four identical coupons can be used for four identical items in a single transaction.

  • Expiration Dates: Coupons must be presented by the consumer on or before the expiration date. Retailers are strictly prohibited from accepting coupons after their expiration date.

  • Sales Tax: The consumer is responsible for paying any applicable sales tax on the purchased items.

 

3. Processing Coupons for Payment

  • Submission: Properly redeemed coupons should be submitted directly by the Retailer or through an authorized clearinghouse. Unauthorized intermediary submissions will not be accepted.

  • Reimbursement: For each valid coupon, the Company will reimburse the following:

    • Face Value: The face value of the coupon or, in the case of a free goods coupon, the lesser of the retailer’s selling price and the maximum value of the coupon.

    • Handling Fee: An allowance of $0.08 for each properly redeemed coupon, covering all handling and processing expenses.

    • Shipping Costs: Reasonable, actual direct ground postage for transporting coupons to the Company’s authorized agent. Additional fees or charges will not be reimbursed.

  • Submission Deadline: Coupons must be received by the Company within six (6) months of the expiration date to be honored.

  • Right to Audit: The Company reserves the right to audit any coupon submissions and may request proof of purchase to verify sufficient stock was purchased to cover the coupons submitted.

 

4. Denial and Penalties

  • Misredemption: The Company will deny reimbursement for coupons that exhibit signs of misredemption or fraud. Indicators of fraudulent coupons include, but are not limited to:

    • Coupons that have been reproduced, photocopied, mutilated, trimmed, or altered in any way.

    • Coupons in mint condition or sequentially numbered, suggesting mass cutting or counterfeiting.

    • Coupons showing evidence of tape, similar cuts or tears, or other indications of tampering.

    • Coupons featuring the Company’s barcode but displaying images or descriptions of products from another brand, company, or product line, indicating potential fraud or misrepresentation.

    • Excessive or unusual patterns of redemption, such as large quantities of identical coupons submitted in a manner inconsistent with normal retail sales.

  • Right to Void Coupons: The Company reserves the right to cancel or void any coupon or promotion if fraudulent activity is detected. This includes, but is not limited to, situations where coupons are altered, counterfeited, or misused in any manner.

  • Unauthorized Deductions: Retailers are not permitted to deduct any amounts related to coupon redemption from the Company’s invoices. Unauthorized deductions may result in suspension of credit or shipments until repayment is made.

  • Legal Action: Any fraudulent activity or failure to adhere to this Policy may result in legal action, including forwarding coupons to law enforcement agencies for investigation.

 

6. Limitation of Liability

 

The Company’s sole obligation under this Policy is limited to reimbursing Retailers as specified herein for valid coupons redeemed in accordance with this Policy. In no event shall the Company be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or related to this Policy, including but not limited to, loss of profits, revenue, or business opportunities.

 

7. Miscellaneous

  • Governing Law: This Policy is governed by the laws of the state of Michigan and Wayne County. Any legal action must be brought within one (1) year of the submission date giving rise to the claim.

  • Policy Changes: The Company reserves the right to modify, revise, or terminate this Policy at any time without prior notice.

  • Severability: If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalidity of any part shall not affect the validity of the remaining parts of this Policy.
